The Tenth Circuit Court of Appeals Hands Amigos Bravos a Victory |
| On January 3, 2001, a three-judge panel of the U.S. Tenth Circuit Court of Appeals reinstated the lawsuit Amigos Bravos filed against EPA in 1998. The purpose of the lawsuit was to force EPA to stop Molycorp from allowing polluted water from its waste rock piles from seeping into the Red River (see story on page 1). The appellate court stated that the lower court erred in using the outcome of Amigos Bravos' 1995 lawsuit against Molycorp as the basis for dismissal. The appellate court remanded the case to the lower court. URS identified as "new lead consultant by Molycorp At the latest Technical Review Committee meeting regarding the preparation of a closeout and reclamation plan for the mine site, Molycorp introduced a new set of "lead" consultants. Robertson GeoConsultants Inc., the firm that has been Molycorp's lead consultants for the project was replaced by URS. Despite having prepared a number of reports, representatives of Robertson GeoConsultants were not present at the meeting. According to Fortune Magazine, URS is a "giant global engineering company with $2 billion in revenues and 15,000 employees. We wonder why Unocal chose to change horses mid-stream.
